Welcome to Giving Connect. These Terms of Service ("Terms") govern your access to and use of the Giving Connect website, mobile applications, messaging tools, and related services (collectively, the "Services") operated by Giving Connect, LLC ("Giving Connect," "we," "us," or "our").

Please read these Terms carefully before using the Services.

By accessing or using the Services, creating an account, or otherwise interacting with the platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

1. Our Mission

Giving Connect exists to help connect people who want to give with organizations that can put those donations to work in their communities.

Our goal is to make giving easier, more transparent, and more impactful by helping donors find organizations with real, current needs. We ask all users to participate honestly, respectfully, and in a manner that supports the mission of strengthening local communities.

2. Eligibility

You must be at least eighteen (18) years old and capable of forming a legally binding agreement to create an account or use the Services.

By creating an account or using the Services, you represent and warrant that:

  • You are at least eighteen (18) years old;
  • The information you provide is accurate and complete;
  • You will comply with these Terms and all applicable laws.

Giving Connect does not knowingly permit individuals under the age of eighteen (18) to create accounts or use the Services.

3. Description of Services

Giving Connect is a technology platform that facilitates connections between donors, nonprofit organizations, community partners, schools, faith-based organizations, government entities, and other approved organizations.

The Services may allow users to:

  • Create user accounts;
  • Search for organizations and community needs;
  • Submit donation commitments;
  • Coordinate donations;
  • Communicate through platform messaging tools;
  • Access location-based features;
  • Receive notifications regarding donation activity.

4. Giving Connect Is Not a Party to Donations

Giving Connect serves solely as a technology platform.

Giving Connect does not:

  • Take possession of donated items;
  • Inspect donated items;
  • Store donated items;
  • Transport donated items;
  • Receive donated items;
  • Distribute donated items;
  • Guarantee donation fulfillment;
  • Guarantee item availability;
  • Guarantee organization participation.

All donation-related activities occur directly between users and participating organizations.

Giving Connect is not a party to any donation transaction.

5. User Responsibilities

Users are solely responsible for:

  • The items they donate;
  • The accuracy of information they provide;
  • Communications with organizations;
  • Compliance with applicable laws;
  • Evaluating the suitability and safety of donated items.

Users agree not to submit false, misleading, fraudulent, or inaccurate information through the Services.

6. Organization Responsibilities

Organizations are responsible for:

  • Maintaining accurate profiles;
  • Posting accurate donation needs;
  • Updating needs when circumstances change;
  • Complying with applicable laws;
  • Reviewing and managing donations received.

Giving Connect may review organization information but does not guarantee the legitimacy, charitable status, qualifications, conduct, reliability, or activities of any organization.

Users are responsible for conducting their own evaluation before participating in donation activities.

7. Donation Availability and Information Accuracy

Donation requests, organization profiles, operating hours, locations, donation needs, and other information displayed through the Services are provided for informational purposes only.

Organizations and users are responsible for maintaining accurate and current information.

Giving Connect does not guarantee the accuracy, completeness, timeliness, availability, reliability, or suitability of any organization listing, donation request, posted need, operating hour, location, communication, or other user-provided information.

An organization's needs may change without notice, and Giving Connect does not guarantee that an organization will continue to need, accept, or be able to receive a particular item at the time of donation.

Users are responsible for independently verifying information before coordinating or completing a donation.

8. Messaging and Communications

The Services may include messaging and communication features.

Users agree that communications transmitted through the platform may be stored, reviewed, monitored, or disclosed as reasonably necessary to:

  • Provide customer support;
  • Investigate violations of these Terms;
  • Protect users and organizations;
  • Enforce platform policies;
  • Comply with legal obligations.

Users may not use the messaging system for harassment, solicitation, fraud, unlawful conduct, or abuse.

9. Prohibited Items

Users may not offer, request, donate, distribute, or coordinate the donation of:

  • Firearms or weapons;
  • Ammunition;
  • Explosives;
  • Illegal drugs or controlled substances;
  • Alcohol;
  • Tobacco or nicotine products;
  • Hazardous or toxic materials;
  • Counterfeit goods;
  • Stolen goods;
  • Recalled products;
  • Live animals;
  • Illegal items;
  • Any item prohibited by applicable law.

Giving Connect reserves the right to remove listings and suspend accounts associated with prohibited items.

10. User Content

Users may submit content including:

  • Organization information;
  • Donation requests;
  • Messages;
  • Logos;
  • Images;
  • Profiles;
  • Other materials.

Users retain ownership of their content.

By submitting content to the Services, users grant Giving Connect a non-exclusive, worldwide, royalty-free license to host, display, reproduce, distribute, and modify such content solely for purposes of operating, improving, and promoting the Services.

11. Location Services

The Services may utilize GPS, device location information, addresses, and mapping services to help users locate organizations and donation opportunities.

By enabling location services, users consent to the collection and use of location information as described in the Privacy Policy.

12. Account Suspension and Termination

Giving Connect reserves the right to suspend, restrict, or terminate accounts at any time for:

  • Violations of these Terms;
  • Fraudulent activity;
  • Misuse of the Services;
  • Safety concerns;
  • Illegal activity;
  • Conduct that may harm users, organizations, or the platform.

13. No Tax, Legal, or Financial Advice

Giving Connect does not provide tax, legal, accounting, or financial advice.

Users are solely responsible for determining whether any donation qualifies for a tax deduction or other benefit.

Any tax documentation, if applicable, must be obtained directly from the receiving organization.

14. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

Giving Connect makes no warranties, express or implied, regarding:

  • The availability of the Services;
  • Donation fulfillment;
  • User conduct;
  • Organization conduct;
  • The condition or safety of donated items;
  • The accuracy of content provided by users.

15. Limitation of Liability

To the fullest extent permitted by law, Giving Connect, LLC and its owners, officers, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from:

  • Use of the Services;
  • Donations or donation-related activities;
  • User conduct;
  • Organization conduct;
  • Messaging between users;
  • Property damage;
  • Personal injury;
  • Loss of data;
  • Lost profits;
  • Platform interruptions.

Users assume all risks associated with participation in donation activities facilitated through the Services.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida without regard to conflict of law principles.

17. Venue

Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

18. Changes to These Terms

Giving Connect may modify these Terms from time to time.

Updated Terms will be posted on the Services with a revised Effective Date.

Continued use of the Services after any changes constitutes acceptance of the updated Terms.
